One Response to Andrew Napolitano and Tom Woods on Nullificatin and 10th Amendment State Sovereignty

  1. Norman Browne says:

I believe nullification could easily be accomplished in an area where the Federal government relies on the States as tax collectors, such as the gasoline tax. A great majority of the States are donors, that is they get back less in highway funds than they collect, and are subject to blackmail to receive what they do get.

Why could a State legislature not repeal all Federal gasoline taxes in that State, and simultaneously pass State gasoline taxes equal to those Federal taxes repealed, cutting out the middleman, and the massive fraud and waste in the redistribution of the funds.
